Terms of Service

1. Definitions

• Client: Any individual or entity purchasing or using Techscrafts services.
• Services: Any digital or technical service we offer, including but not limited to:
  • Custom software development
  • No-code and low-code solutions
  • Automations & workflow engineering
  • AI integrations and AI-powered systems
  • API development and integrations
  • Web & mobile app development
  • UI/UX design
  • Consulting, technical architecture & digital strategy
• Project: Any agreed-upon work defined through proposals, contracts, statements of work (SOWs), or written communication.

2. Scope of Services

Techscrafts delivers custom digital solutions, meaning the tools and technologies used depend on the client's needs. This may include:

• No-code platforms (Bubble, Webflow, Glide, etc.)
• Low-code or automation platforms (Make.com, Zapier, n8n)
• Full-code environments (Node.js, React, TypeScript, etc.)
• AI tools (OpenAI, Claude, Vision models, etc.)
• Cloud providers (Supabase, Firebase, AWS, Vercel, etc.)

The exact scope is defined per project and must be mutually approved before work begins.

3. Payments & Billing

• Work starts upon receiving the initial deposit unless otherwise stated.
• Deposits are non-refundable.
• All invoices must be paid by the specified due date.
• Late or incomplete payments may delay delivery, pause the project, or restrict access to deliverables.
• Additional features or revisions requested outside the agreed scope will be billed separately.
• Techscrafts may charge interest or administrative fees on unpaid invoices older than 14 days.

4. Revisions & Scope Management

• A project includes revisions as defined in the proposal.
• Requests outside the original scope constitute new work and will be quoted separately.
• Techscrafts reserves the right to adjust costs and timelines if the scope expands.

5. Client Responsibilities

The client agrees to:

• Provide timely feedback, approvals, and required materials.
• Supply accurate information, content, and credentials needed to complete the project.
• Ensure all provided content complies with legal and copyright regulations.
• Maintain any accounts or third-party services used in the solution (API keys, billing, cloud services, etc.).

Techscrafts is not responsible for delays caused by incomplete information or late approvals.

6. Intellectual Property

• Final deliverables belong to the client after full payment.
• Techscrafts retains ownership of:
  • Internal frameworks
  • Custom workflows
  • Reusable scripts, templates, or components
  • AI prompts, architecture frameworks, or development patterns
• Techscrafts may display non-sensitive parts of the project in portfolios unless restricted by NDA.

7. Use of Third-Party Tools & AI Services

Many solutions rely on third-party platforms or AI tools.

By using our services, you acknowledge that:

• Pricing, policies, and service availability of third-party tools may change.
• Techscrafts is not liable for downtime, bugs, or outages caused by external platforms.
• Ongoing usage fees for such tools are the client's responsibility unless otherwise agreed.

8. Timelines & Delivery

Estimated timelines depend on:

• Project complexity
• Client responsiveness
• Technical requirements
• Third-party systems

Delays caused by the client or external platforms are outside Techscrafts' control.

9. Quality Assurance & Warranty

• Techscrafts tests all features prior to delivery.
• After handover, clients have 14 days to report bugs for free fixes (unless a maintenance plan is active).
• Techscrafts does not guarantee future functionality against platform changes, API updates, or technological shifts.
• Services are provided "as-is" without warranties beyond what is explicitly stated.

10. Limitation of Liability

To the fullest extent permitted by law:

• Techscrafts is not liable for indirect, incidental, consequential, or financial damages arising from service use.
• Total liability is limited to the amount paid for the specific project.

11. Confidentiality

Both parties agree to treat confidential information with care.

An NDA may be signed upon request.

12. Termination

Either party may terminate the agreement if:

• The other party breaches terms
• The client fails to provide required inputs or payments
• The project becomes unfeasible due to client-side constraints

All completed work up to termination remains billable.

13. Governing Law

These Terms are governed by the laws of Kenya unless otherwise stated in the project contract.

14. Updates to These Terms

Techscrafts may update these Terms at any time. Continued use of the website implies acceptance.
